Administrative and Justice Subcommittee Approves Laws Related to Administrative Judiciary

The subcommittee emanating from the Committee on Administration and Justice, tasked with studying proposed laws related to the administrative judiciary, held a session chaired by committee president Deputy George Okais, with the presence of Deputies Hussein Al-Haj Hassan and Halima Al-Qaqour. Attending from the Ministry of Justice was Judge Nadine Rizk, from the State Council was Judge Samih Madah, from the Judges Club of Lebanon was Judge Mohammed Fawaz, from the Beirut Bar Association was Lawyer Rizk Zghib, and from the Tripoli Bar Association was Lawyer Mohammed Haram.

In a previous session, the committee had studied the role of the reporting consultant and the possibility of appealing his report, in addition to how to submit the report and the role of the reporter in matters related to public order. The discussion covered the role of the government commissioner and his opinions, the role of the ruling body after the exchange of lists is concluded and inviting parties to present their remarks, as well as the additional memos accepted by the court.

In this session, the committee continued to study the articles of the proposed laws related to the administrative judiciary, discussing provisions of Chapter Four concerning expedited procedures and the topics that may be subject to these proceedings and the related timelines. The committee then moved on to examine the articles of Chapter Five concerning the review process, studying the administrative decisions that the administrative judiciary can annul, as well as decisions considered nonexistent, and the jurisdiction of this judiciary regarding administrative contracts.

As a result of the discussion and deliberation, the committee approved the articles it studied, after making amendments to several of them. The session was adjourned, with the committee scheduled to continue its work in the next session.
