"Batman" Wins Dispute with Italian Designer Over Trademark

A European court ruled today, Wednesday, in favor of "Batman" and the European Union Intellectual Property Office, determining that the Batman logo is distinctive and famous enough to warrant its trademark within the European bloc, thus ending a dispute with an Italian designer. The court stated: "The evidence submitted to the General Court is insufficient to demonstrate that the EU trademark representing a bat in an oval lacked distinctiveness at the time the registration application was filed."

DC Comics, part of Warner Bros. Discovery, faced a challenge from the Italian retail company "Comerchali Italiana" in 2019. The Italian firm requested the cancellation of the trademark for clothing and celebration and festival items, claiming it "lacks distinctive character." After the office rejected the company's request, Comerchali Italiana filed a lawsuit with the General Court in Luxembourg, where the judges upheld the stance of the European Union Intellectual Property Office.
