The indictment authority in Mount Lebanon, presided over by Judge Amira Shahrour, along with advisors Heba Hashem and Joseph Tamer, has issued its decision regarding the child abuse case at the Garde rêve nursery. The decision reached includes the following:
The accused, Djini Al-Halou, is charged with a felony under Article 547 combined with Articles 189 and 201 of the Penal Code, following confirmation of her foreseeing the criminal outcome, which involved the possible death of any of the children, especially infants, due to choking or being affected by blows, particularly those to the head, resulting from her abusive actions, which she did not restrain from despite being warned of their dangers. Furthermore, the outcome did not occur due to reasons beyond her control. She is also suspected of committing a misdemeanor under Article 554 combined with Articles 559 and 257 of the Penal Code, for having harmed other children, and under Article 584 for directing offensive remarks towards the children and their families.
Additionally, the decision included charges against the accused, Joumana Abu Said and Tony Mahna, under Article 547 combined with Articles 219, 201, and 189, due to their passive behavior, evidenced by their failure to aid the abused children despite their awareness of the serious and dangerous nature of the abuse enacted by Djini Al-Halou against them, and their foreseeing the potential death of any of the children from choking or being affected by blows, as established in the recorded visual and audio footage. This outcome was also not achieved due to circumstances beyond Djini Al-Halou's control. They are also suspected of committing a misdemeanor under Article 554 combined with Articles 559, 275, and 219 concerning Joumana Abu Said, for having physically assaulted and harmed some of the other children.
