Death Sentence for Doctor Who Raped His Wife's Underage Sister

From the very first session, the 26th Criminal Court in South Giza, Egypt, referred a suspect, accused of kidnapping and raping his wife's sister, to the Grand Mufti of the Republic to obtain a legal opinion on his execution. The incident began when the October Police received a complaint in August from a 44-year-old woman, "A. H. A," stating that her 15-year-old daughter, "M. A. A," had been raped by her older daughter's husband, "Mostafa S. M." He convinced the second girl and had sexual relations with her multiple times while she was living with them.

The prosecution referred the suspect, "Mostafa S," a well-known cosmetic surgeon, on charges of raping "M. A," the 15-year-old sister of his wife, during her stay with them. It was stated that he "took advantage of his wife's absence and forced her, in addition to kidnapping her into another apartment he owned, where he raped her again, exploiting her young age."

The victim's lawyer called for the maximum penalty to be imposed on the suspect, as the provisions of Article 267 of the Penal Code apply, which states that "whoever rapes a female without her consent shall be punished by death or life imprisonment, and the perpetrator shall be punished by death if the victim has not reached the age of eighteen or if the perpetrator is a relative of the victim, or in charge of her care or supervision, or has authority over her, or is a paid servant of her or the aforementioned."

The defense, in its plea, clarified that "the elements of the crime are established with both the material and intentional elements present for the suspect, and the aggravated circumstances of this heinous crime are primarily the fact that the victim has not yet reached 18 years of age, and secondly, that the suspect is related to the victim, being among those responsible for her care or supervision."
