"The Ministry of Education and Higher Education wishes to clarify, in light of the ongoing confusion regarding the status of independent student applications and the process of issuing certifications. The main issue lies in the wording of the law passed by the House of Representatives.
The law stipulated the cancellation of official Brevet and Baccalaureate exams, granting certifications to third-year secondary students and technical baccalaureates. However, it did not specify the legal and procedural mechanism for issuing certifications, particularly for the intermediate certificate, and did not address the situation of candidates from independent applications.
Conversely, the minutes of the House of Representatives' session discussions indicate the approval of conducting official exams for independent applications, rather than granting them certifications, without specifying any method for organizing these exams if adopted.
To ensure the proper implementation of the law and to avoid any actions that might contravene its provisions, the Ministry of Education and Higher Education found itself compelled to seek the opinion of the Legislation and Consultation Authority on these matters. They are awaiting the legal opinion to make an appropriate decision, whether concerning the issuance of certifications or the status of independent applications, in a manner that aligns with the correct legal interpretation of the text.
Therefore, the Ministry urges waiting for the legal opinion before sharing any conclusions or inaccurate information, affirming it will announce the decision upon its receipt, safeguarding the rights of all candidates and ensuring the proper application of the law. This clarification was deemed necessary."
