Update on the Case of Little Sophia Mshleb

Today, Wednesday, the individual criminal judge in Metn, Carla Rahal, issued a ruling regarding the complaint filed by the head of the investigations committee in the Doctors' Syndicate, Claude Samaan, against Fawzi Mshleb, the father of the child Sophia who suffered a medical error at the Hotel Dieu Hospital. Samaan sought compensation of 500 million Lebanese pounds, equivalent to 330,000 dollars at the time the complaint was filed. She claimed that the child's father exceeded the procedural norms by filing a criminal complaint against her before the investigating judge in Mount Lebanon.

The investigating judge, Sandra Mehtar, issued a provisional decision against the plaintiff and against former president of the Doctors' Syndicate, Raymond Sayegh, for issuing a false report from the Doctors' Syndicate. Judge Rahal ruled that "Fawzi Mshleb's claim was valid and that the report issued by the Doctors' Syndicate did not reflect the medical reality of the child, and the report concealed essential information to prevent the emergence of reasons for brain damage. The report is a false document that falls under Article 466 of the Penal Code, which carries a penalty of two years in prison."

The ruling concluded by rejecting the complaint as fundamentally illegal and charging the physician Claude Samaan with all fees and expenses. The defendant was represented by lawyers Ayman Jaziri and George Khoury.
