A U.S. judge has rejected Burger King's attempt to dismiss a lawsuit accusing the restaurant of deceiving hungry customers by portraying its "Whopper" sandwich as larger than it actually is. U.S. Judge Roy Altman in Miami stated that the restaurant must defend itself against the claim that the images of the Whopper on its menu mislead customers, which could amount to a breach of contract. The customers in the class action lawsuit alleged that the sandwiches are depicted overflowing with ingredients, making them appear 35% larger and featuring about twice the amount of meat compared to what the restaurant chain actually serves. The restaurant responded that it is not required to provide sandwiches that look "exactly like the picture," but the judge noted that the decision on this matter is up to the jurors.
