A girl filed a lawsuit before the Abu Dhabi Primary Court, demanding that the defendant compensate her for damages and provide her with financial and moral compensation for lost earnings amounting to 150,000 dirhams with legal interest at 12%, as well as covering the costs and expenses. She explained her case by stating that the defendant was her husband, and due to a dispute between them, he assaulted her. This led to a report being filed with the Family Court, which resulted in a conviction of the accused and a sentence of 6 months in prison, suspended, along with a fine of 10,000 dirhams.
The medical report submitted in the case indicated that the assault suffered by the girl was minor, as she sustained superficial scratches on her face, a bruise on the outer side of her left forearm, and a bruise on the outer side of her right arm, with her general condition being stable and no complications present. The representative of the defendant submitted a memorandum requesting the dismissal of the case due to lack of validity and evidence, arguing that there were no damages incurred by the complainant, and attached the ruling issued by the Personal Status Court, which decreed the divorce of the complainant from him, granting her an irrevocable divorce for harm.
The first-degree court issued a ruling obliging the defendant to pay the complainant an amount of 15,000 dirhams along with legal interest at a rate of 5% until the decision becomes final, with interest commencing from that date until full payment, and ordering him to bear the costs and expenses. The complainant did not accept this decision and appealed it.
The Abu Dhabi Court of Appeals modified the first-degree court's judgment and ruled again that the defendant must pay the complainant the amount of 30,000 dirhams with legal interest on this amount at a rate of 5% from the date of this ruling, and ordered him to cover the costs and expenses for both stages of the litigation. Thus, the total amounts he had to pay for this act reached 40,000 dirhams.
